Tratamiento jurídico de la violencia intrafamiliar contra la mujer en Colombia: desde una perspectiva teórica

Resumen
En los últimos años la dinámica del contexto familiar se ha visto permeado por cambios
relevantes producidos por los escenarios de carácter cultural, económico y político. Lo
anterior ha propiciado que su estructura y funciones se adapten a las nuevas exigencias del
entorno globalizado, por tal razón su dinámica se encuentra estrechamente relacionada e
influenciada con el contexto social que la rodea. De acuerdo a estos cambios el objetivo del
proyecto se centra en analizar el tratamiento jurídico de la violencia intrafamiliar contra la
mujer en Colombia desde 1993 hasta 2019. La metodología utilizada es de corte cualitativo
bajo el método de revisión documental. Los resultados muestran que Colombia dispone de
normativas Constitucionales y penales pertinentes emitidas para castigar las conductas de
violencia intrafamiliar contra la mujer, a pesar de estos esfuerzos, se denota que las mismas
no han sido eficaces para contrarrestar el flagelo social debido a que se presentan
inconsistencias al ser aplicada y carece del componente social para que su tratamiento no sea
correctivo sino preventivo. Ante esto se concluye la necesidad de tratar esta problemática de
manera jurídico – social, por lo que se requiere diseñar nuevas estrategias en las que se
articulen los dos componentes.
In recent years, the dynamics of the family context has been permeated by relevant changes produced by cultural, economic and political scenarios. The foregoing has allowed its structure and functions to adapt to the new demands of the globalized environment, for this reason its dynamics is closely related and influenced by the surrounding social context. In accordance with these changes, the objective of the project is to analyze the legal treatment of domestic violence against women in Colombia from 1993 to 2019. The methodology used is qualitative under the method of documentary review. The results show that Colombia has relevant Constitutional and criminal regulations issued to punish behaviors of domestic violence against women, despite these efforts, it is denoted that they have not been effective in counteracting the social scourge due to inconsistencies when applied and lacks the social component so that its treatment is not corrective but preventive. Given this, the need to treat this problem in a legal-social way is concluded, so it is necessary to design new strategies in which the two components are articulated.
