Resumen
Antecedentes: El presente trabajo tiene como propósito explicar el rompimiento de la solidaridad en el pago de servicios públicos domiciliarios, a pesar que artículo 130 de la Ley 142 de 1994 contempla la figura de la solidaridad, la cual aplica para las obligaciones y los derechos derivados del acuerdo. Esta investigación es de tipo documental, en la cual se estudió información registrada sobre la figura de la solidaridad en el pago de servicios públicos y su rompimiento, permitiendo hacer un análisis de tipo normativo. Los conceptos que se desarrollan en el presente trabajo se referencian y armonizan con la normatividad y reglamentación relacionada con la solidaridad de los servicios públicos domiciliarios y su rompimiento, debido a que presentan situaciones relacionadas con la vulneración de derechos a los usuarios. En esta medida se trabajaron tres capítulos en donde el primer capítulo habla de los intervinientes en el contrato de condiciones uniformes contrato de servicios públicos, el segundo capítulo hace mención a las obligaciones derivadas del contrato de condiciones uniformes “contrato de servicios públicos y el tercer capítulo hace énfasis en la configuración del rompimiento en cuanto a la solidaridad en la obligación del pago de servicios públicos domiciliarios. De acuerdo con lo anterior, con este trabajo se busca establecer cómo se presenta el rompimiento del principio de la solidaridad en cuanto al pago en los servicios públicos domiciliarios.
Objetivos: Con este trabajo se busca establecer cómo se presenta el rompimiento del principio de la solidaridad en cuanto al pago en los servicios públicos domiciliarios.
Materiales y Métodos: Esta investigación es de tipo documental, en la cual se estudió información registrada sobre la figura de la solidaridad en el pago de servicios públicos y su rompimiento, permitiendo hacer un análisis de tipo normativo. Los conceptos que se desarrollan en el presente trabajo se referencian y armonizan con la normatividad y reglamentación relacionada con la solidaridad de los servicios públicos domiciliarios y su rompimiento, debido a que presentan situaciones relacionadas con la vulneración de derechos a los usuarios.
Resultados: Conforme a la Ley 142 de 1994, se tiene establecido quienes son partes en el contrato de servicios públicos: A) la Empresa prestadora del servicio, B) El suscriptor y/o usuario/suscriptores. De acuerdo con lo anterior, la Ley dispuesto la solidaridad entre el propietario o poseedor del bien inmueble que goza del servicio, igualmente definió que el suscriptor y el usuario final del servicio son solidarios y responderán por las obligaciones y deberes que se han establecido en el contrato.
Conclusiones: Podemos concluir que la existencia del principio de solidaridad en cuanto al pago de los servicios públicos domiciliarios en Colombia tiene un origen constitucional, esto debido a que el Estado tiene una función como garante en la prestación de los servicios públicos, así mismo por ser Colombia un Estado Social de Derecho este tiene el deber de garantizar la prestación de dichos servicios. Así mismo al analizar principio de solidaridad, se concluye que dicho principio se enmarca en la relación existente entre el dueño, el suscriptor y el usuario final del bien inmueble, lo que permite que se logre determinar claramente ante quien recaer la solidaridad por deudas contraídas derivadas del consumo de los servicios públicos prestados por las empresas prestadoras del mismo dentro del contrato arrendamiento o en su defecto de condiciones uniformes. Si bien existe una solidaridad o participación en el pago de los servicios públicos, también es cierto que esta no es absoluta debido a que solo es aplicable para el cobro de los tres meses en que se incurrió en mora el usurario, transcurridos estos tres meses se rompe la solidaridad y el propietario no se hace responsable del pago de la deuda.

In accordance with the foregoing, the Law provides solidarity between the owner or possessor of the real estate that enjoys the service, it also defined that the subscriber and the end user of the service are joint and several and will be responsible for the obligations and duties that have been established in the contract. Conclusions: We can conclude that the existence of the principle of solidarity regarding the payment of residential public services in Colombia has a constitutional origin, this is due to the fact that the State has a function as guarantor in the provision of public services, also because Colombia is a Social State of Right this has the duty to guarantee the provision of said services.
