Acciones jurídicas ante autoridades judiciales sobre hechos de violencia intrafamiliar, interpuestas por mujeres (víctimas) en el municipio de San José de Cúcuta, durante el periodo 2019 – 2020

Resumen
Es un estudio en el cual la violencia intrafamiliar donde se clasifica como una afectación social y se buscó observar lo garantista que puede llegar hacer el Estado en esta situación que actualmente se denomina como problemática publica y general sobre las herramientas normativas adaptadas con fines de identificar un problema bastante común y que, a origen de la pandemia, dio un alcance significativo sobre años anteriores, la violencia intrafamiliar, está ligada en el fondo con la violencia de género y otros tipos de violencia que puede presenciar una víctima, se pretendió establecer cuáles son las consecuencias jurídicas y que tanto se ha realizado jurídicamente en pro de la protección de los derechos y libertades de quienes fueran víctimas de este fenómeno de manera directa, a través de la aplicación de una metodología basada en el paradigma interpretativo, con enfoque cualitativo y de método hermenéutico, desarrollada por el autor Edmundo Husserl quien cataloga a la fenomenología como una forma de distinguir las situaciones a través de nuestra forma de percepción de la realidad de las bases conceptuales del conocimiento; por eso este estudio se basó en la realidad social de las mujeres cucuteñas que diariamente son víctimas de este fenómeno social mediante informes estadísticos del Instituto de Medicina legal, leyes y decretos creados en base a la protección de los derechos y las libertades de las víctimas de la violencia intrafamiliar llegando a concluir que la violencia intrafamiliar se establece como un fenómeno social entrañado desde la costumbre identificando los tipos de violencia que hacen parte de este y como desde la administración pública local se pueden crear rutas de atención primaria para las víctimas
This is a study in which family violence is classified as a social issue, and the aim was to observe how much the State can be a guarantor in this situation, which is currently considered a public and general problem. The study also aimed to identify common problems and the normative tools adapted to identify them, and which, as a result of the pandemic, have had a significant impact in recent years. Family violence is fundamentally linked to gender-based violence and to other types of violence that victims may experience. The study sought to establish what juridical consequences there are and how much has been done legally to protect the rights and freedoms of direct victims of this phenomenon. The study used a methodology based on the interpretative paradigm, with a qualitative and hermeneutic approach, developed by the author Edmund Husserl, who classified phenomenology as a way of distinguishing situations through our perception of the reality of the conceptual bases of knowledge. As such, this study was based on the social reality of the women of Cucuta who daily victims of this social issue are, based on statistical reports from the Institute of Legal Medicine, laws, and decrees created to protect the rights and freedoms of victims of family violence. It was concluded that family violence is a deeply entrenched social issue, rooted in custom, and types of violence that are part of it were identified. The study also demonstrated how, from the local public administration, primary care routes can be created for victims of family violence.
