Resumen
En el presente escrito se profundizará sobre el Artículo 4º de la Ley 599 de 2000, el cual se refiere a la función de la pena, el cual expresa su objeto que básicamente se funda en lograr que los penados se resocialicen y disminuir el porcentaje de reincidencia, teniendo en cuenta que en Colombia existe un alto porcentaje de personas que después de cumplida su pena, continúan reincidiendo en el delito, hecho que lleva a reflexionar acerca del buen funcionamiento del Sistema Penitenciario, y analizar si realmente se cumple con este propósito.
En Colombia existe un grave problema de hacinamiento en las diversas cárceles del país, el cual se puede deducir que se ha presentado mucha indiferencia y poco interés por parte de las autoridades pertinentes para buscar solución a esta problemática. Este hecho conlleva a que no se cumpla completamente con el objetivo de resocializar a los internos, y que estos sean preparados para enfrentar una vida digna al culminar sus penas.
De la misma manera se puede palpar que no se ha podido cumplir con el objetivo de la pena, de rehabilitar y resocializar al penado, entre los cuales se puede mencionar el caso de que le son vulnerados los mínimos derechos a los condenados, debido al hacinamiento carcelario, falta de personal en el INPEC,
estigmatización al condenado, exposición en medios de comunicación, linchamientos con resultado de muerte en algunos casos; falsa información suministrada por los medios de comunicación, redes sociales entre otros, elementos que no permiten el cumplimiento del propósito de la pena, de acabar con el aumento delincuencial.
In this writing, Article 4 of Law 599 of 2000 will be deepened, which refers to the function of the penalty, which expresses its purpose, which is basically based on getting the convicts to resocialize and reduce the percentage of recidivism. , taking into account that in Colombia there is a high percentage of people who, after serving their sentence, continue to reoffend in crime, a fact that leads us to reflect on the proper functioning of the Penitentiary System, and to analyze whether this purpose is really fulfilled. In Colombia there is a serious problem of overcrowding in the various prisons in the country, which can be deduced that there has been a lot of indifference and little interest on the part of the relevant authorities to find a solution to this problem. This fact leads to the fact that the resocialization programs for the inmates are not fully complied with, and that they are prepared to face a dignified life at the end of their sentences. In the same way, it can be felt that there are other factors that do not allow the fulfillment of the objective of the sentence, of rehabilitating and resocializing the convict, among which it is possible to mention the case that the minimum rights of the convicts are violated, due to prison overcrowding, lack of personnel at INPEC, stigmatization of the convicted person, exposure in the media, lynchings resulting in death in some cases; false information provided by the media, social networks among others, elements that do not allow the fulfillment of the purpose of the sentence, to end the increase in crime.
