Resumen
El presente artículo de investigación indagó la problemática de la tercerización laboral u Outsorcing en los trabajadores del sector de la salud, y la garantía de los derechos fundamentales establecidos en la Constitución Política, determinando a la vez la problemática de la informalidad laboral en Colombia en donde el DANE destaca un incremento en ciudades como Riohacha, Sincelejo y Cúcuta. Así mismo es importante señalar cómo la tercerización laboral que se encontraba establecida en el Decreto 583 de 2016 fue derogada posteriormente por el Decreto 683 del 2018.
También, se indagó sobre la importancia de la dignidad humana en las Empresas Sociales del Estado, y como los trabajadores que se encuentran subcontratados ven violentados sus derechos laborales ante la falta de garantías por parte del Estado. El artículo de investigación se abordó desde un enfoque cualitativo, bajo un diseño hermenéutico y desde un paradigma interpretativo, lo cual permitió analizar y determinar la problemática de tercerización laboral en Colombia, especialmente en el sector de la salud.
Además, se realizó desde un análisis documental de revistas indexadas que aportaron, al problema investigativo un contexto frente a la protección laboral y la dignidad laboral, la cual debe ser tratado como lo que se es, y teniendo una perspectiva desde la jurisprudencia de la Corte Constitucional. Finalmente, desde la sentencia C-614 del 2009 se destaca la prohibición de la contratación por prestación de servicios, debido a que los empleadores evitan un verdadero vínculo laboral entre los sujetos parte, como lo son empleador y trabajador.
This research article investigated the problem of labor outsourcing or outsourcing in workers in the health sector, and the guarantee of the fundamental rights established in the Political Constitution, determining at the same time the problem of labor informality in Colombia where DANE highlights an increase in cities such as Riohacha, Sincelejo and Cucuta. Likewise, it is important to point out how the labor outsourcing that was established in Decree 583 of 2016 was later repealed by Decree 683 of 2018. Also, they inquired about the importance of human dignity in the Social States of Rights and how workers who are subcontracted see their labor rights violated due to the lack of guarantees on the part of the State. The research article was approached from a qualitative approach, under a hermeneutic design and from an interpretative paradigm, which allowed analyzing and determining the problem of labor outsourcing in Colombia, especially in the health sector. In addition, it was carried out from a documentary analysis of indexed journal that contributed, to the investigative problem, a context regarding labor protection and labor dignity, which must be treated as what it is, and having a perspective from the jurisprudence of the Court.
