Resumen
En este artículo se hace una reflexión sobre la delimitación y el campo de acción de responsabilidad patrimonial sanitaria del Estado y responsabilidad patrimonial médica del Estado. La problemática surge porque la jurisprudencia patria no establece criterios que permitan diferenciar ambos conceptos. Debido a ello, en este texto se procurará proporcionar insumos teóricos y jurisprudenciales que conduzcan a establecer derroteros que delimiten ambas figuras, de modo que se logre no sólo despejar las dudas e incógnitas que se presentan cuando se trata de identificar el evento adverso, sino el título de imputación que se debe aplicar en presencia de uno u otro fen6meno. También se abordará 10 concerniente al tratamiento de la causal de exclusión de responsabilidad por la ocurrencia del hecho de un tercero, trátese de una u otra responsabilidad, partiendo de la concepci6n que debe dársele al evento adverso.
This article reflects on the delimitation of the field of action of the patrimonial sanitary responsibility of the State and the patrimonial medical responsibility of the State. The problem arises because there is no boundary line of both concepts. For that reason, in this article we will provide theoretical and jurisprudential inputs that serve to differentiate both figures, with the goal of answering the questions that rise when trying to identify the adverse event and which imputation title should be used in the presence of both phenomenon. Likewise, it is outlined as regards the treatment ofthe causation of exclusion of responsibility for the fact of a third party before one and another responsibility, starting from the conception given to the adverse event.
