Resumen
En Colombia se ha venido proponiendo la adopción de la Cadena Perpetua como herramienta para sancionar a quienes incurren en la violación y/o asesinato de menores de edad. Esto, en parte, se sustenta en el mandato constitucional según el cual los derechos de los niños priman sobre los derechos de los demás y, siendo la vida el principal patrimonio individual del ser humano, el Estado está llamado a velar por ella y brindar garantías a la persona para su preservación. La iniciativa fue aprobada en el Acto Legislativo 01 de 2020, pero la Corte Constitucional halló fundamentos para declararla inexequible, razón por la que no está en vigencia el mandato legislativo y se sigue planteando la posibilidad de su adopción, como alternativa en la lucha contra la violencia de que son objeto muchos niños en Colombia. La exploración permitió establecer que, si bien la comunidad apoya todo acto orientado a la protección infantil, no por ello desconoce algunas deficiencias que se dan al interior del aparato judicial colombiano y que ponen en duda la efectividad de la Cadena Perpetua, en el caso de ser adoptada, por razones ajenas a la naturaleza de la medida, pero fundamentadas en la realidad judicial del país, en la actualidad.
