Resumen
El presente ensayo realiza un análisis de la pensión de sobreviviente de la cónyuge o
compañera permanente de hijos menores hasta los 25 años. Donde encontramos que para poder
llegar a tener esta condición; se debe tener en cuenta las reglas establecidas en la constitución la
ley básicamente dentro de los dos regímenes como son el régimen de prima media y el régimen
de ahorro individual.
Dentro de los anteriores se deben cumplir requisitos diferentes por el cual los hijos del
causante tienen ese derecho, si analizamos este tema debieron pensar humanitariamente.
beneficiando a su núcleo familiar para que no estén desprotegidos. Donde se realizó una
comparación de las sentencias de la corte suprema de justicia la SL 1730 del 2020 y la corte
constitucional la SU 149 – 2021, y de esta forma obtener los requisitos para la pensión de
sobreviviente.
Por otro lado hay que tener en cuenta que este beneficio debe demostrarse con la convivencia
es importante como medio probatorio demostrar los 5 años de convivencia tal cual lo establece el
artículo 47 de la ley 100 y el artículo 13 de lay 797 del 2003 que establece tales requisitos, así
como la sentencia que para mí; cambio la jurisprudencia de este tema que nos ocupa como es la
sentencia SU149- 2021 que dio inicio a una nueva línea jurisprudencial ya que anteriormente con
los 2 años de convivencia la compañera permanente tenía el derecho de recibir este beneficio.
En consecuencia, la familia siendo una comunidad de vida es el núcleo fundamental para
recibir este gran beneficio que para solventar las necesidades principales y no dejar
desamparadas a las mismas.
