Resumen
El estudio titulado "El Título Valor Electrónico" aborda la evolución de los títulos valores en el contexto digital, destacando su importancia dentro del marco normativo colombiano. En un mundo globalizado y digitalizado, la transición hacia títulos valores electrónicos se presenta como una respuesta a la necesidad de mayor rapidez, eficiencia y seguridad en las transacciones comerciales y financieras. El objetivo principal de este trabajo es analizar las normativas que regulan los títulos valores electrónicos en Colombia, explorar los requisitos esenciales para su validación y destacar sus características, particularmente en cuanto a su valor probatorio. La metodología empleada es cualitativa, basada en una revisión bibliográfica exhaustiva de fuentes secundarias, seleccionando investigaciones recientes que abordan aspectos clave sobre los títulos valores electrónicos. A través de un enfoque inductivo, se identificaron patrones y se organizaron los hallazgos en categorías temáticas para proporcionar una visión integral del problema. Los resultados demuestran que los títulos valores electrónicos poseen la misma naturaleza jurídica que los documentos físicos, lo que implica que los principios y características aplicables a los títulos tradicionales también son pertinentes para los electrónicos. La Ley 527 de 1999 ha sido fundamental para su reconocimiento y validez en Colombia, garantizando que los títulos valores electrónicos puedan ser utilizados de manera adecuada en el comercio. Finalmente, se concluye que estos instrumentos ofrecen ventajas como la reducción de costos de almacenamiento y transporte, manteniendo su validez siempre que la información electrónica sea íntegra y no alterada.
The study titled "The Electronic Security Title" addresses the evolution of securities in the digital context, highlighting their importance within the Colombian regulatory framework. In a globalized and digitalized world, the transition to electronic securities is presented as a response to the need for greater speed, efficiency and security in commercial and financial transactions. The main objective of this work is to analyze the regulations that regulate electronic securities in Colombia, explore the essential requirements for their validation and highlight their characteristics, particularly in terms of their evidentiary value. The methodology used is qualitative, based on an exhaustive bibliographic review of secondary sources, selecting recent research that addresses key aspects of electronic securities. Through an inductive approach, patterns were identified, and findings were organized into thematic categories to provide a comprehensive view of the problem. The results demonstrate that electronic securities have the same legal nature as physical documents, which implies that the principles and characteristics applicable to traditional securities are also relevant for electronic securities. Law 527 of 1999 has been fundamental for its recognition and validity in Colombia, guaranteeing that electronic securities can be used appropriately in commerce. Finally, it is concluded that these instruments offer advantages such as reducing storage and transportation costs, maintaining their validity if the electronic information is complete and not altered.
