Resumen
La Inteligencia Artificial como herramienta activa en el sistema jurídico no ha sido aceptada en su totalidad por la sociedad, la razón de ello es que no ha sido comprendida su función dentro del marco legal. Esta investigación parte desde la hermenéutica con enfoque cualitativo por lo cual se abordó el estudio de diferentes posiciones, leyes, programas reguladores y limitantes frente a la utilidad que se le da a la inteligencia artificial y su importancia en la participación de medidas cautelares nominadas. Frente a este proceso se obtuvieron resultados satisfactorios generando un marco normativo alrededor de la responsabilidad de los actos u omisiones de los productos de la IA, la condición jurídica y el control de estos
Artificial Intelligence as an active tool in the legal system has not been fully accepted by society, the reason for this is that its function within the legal framework has not been understood. This research starts from the analytical empirical method with a qualitative approach, which is why the study of different positions, laws, regulatory programs and limitations regarding the usefulness given to artificial intelligence and its importance in the participation of nominated precautionary measures was addressed. In this process, satisfactory results were obtained by generating a regulatory framework around the responsibility for the acts or omissions of AI products, their legal status and control.
