Resumen
La Corte Interamericana de Derechos Humanos, con ocasión de la protección de los Derechos Humanos en los Estados Partes que integran la jurisdicción del Sistema Interamericano de Derecho Humanos creó una figura en el mundo jurídico como lo es el Control de convencionalidad, requiriendo a los Estados Parte el cumplimiento de la Convención Americana de Derechos Humanos haciéndose indispensable la prohibición en la emisión de normas internas que no sean contrarias a esta. Este artículo pretende establecer la aplicación del control de convencionalidad en escenarios de responsabilidad del estado colombiano frente a la violación de Derechos Humanos , a través del análisis del término en sí mismo, el rol de los jueces y la responsabilidad del Estado en casos de dicha índole; mediante una investigación de carácter cualitativa, que desde un diseño hermenéutico realiza un análisis jurídico de dicha aplicabilidad y sobre la jurisprudencia surgida en casos en los cuales Colombia ha estado inmersa. Subyace una gran importancia en el presente análisis jurídico facilitando el debate a nivel nacional e internacional, a la luz de la creciente importancia del control de convencionalidad interno, así como el Derecho Internacional de los Derechos Humanos en nuestra región, tornándose apremiante su profundización, la valoración de los resultados, la aplicación de los acuerdos de los Estados Parte propendiendo por el respeto de los Derechos Humanos
The Inter-American Court of Human Rights, on the occasion of the protection of Human Rights in the States Parties that make up the jurisdiction of the Inter-American Human Rights System, created a figure in the legal world as is the Control of conventionality, requiring from the States Compliance with the American Convention on Human Rights starts, making it essential to create internal rules that are not contrary to it. This article aims to establish the application of conventionality control in scenarios of responsibility of the Colombian state in the face of the violation of Human Rights, through the analysis of the term itself, the role of judges and the responsibility of the State in cases of this nature.; Through a qualitative research, which from a hermeneutical design performs a legal analysis of the applicability and on the jurisprudence that has arisen in cases in which Colombia has been immersed. Underlying great importance in this legal analysis facilitating the debate at the national and international level, in light of the growing importance of internal control of conventionality, as well as the International Law of Human Rights in our region, becoming urgent its deepening, the evaluation of the results, the application of the agreements of the States Parties aiming for the respect of Human Rights
