Resumen
En los últimos años la perspectiva de la vulneración a los derechos fundamentales, ha sido de constantes cambios en torno al acoso laboral en mujeres de Colombia, es por eso que el presente artículo tiene como principal objetivo realizar un análisis documental y jurisprudencial sobre el acoso laboral (MOBBING) como vulneración a los derechos fundamentales de las mujeres en Colombia, mediante una metodología socio-jurídica utilizando como técnica principal se utilizó una revisión documental sobre el cosos laboral en Colombia y una investigación jurídica documental legislativa. Dentro de los resultados, se evidencia desde la Ley 1010 de 2006, los fundamentos claves del acoso laboral en Colombia, de sus lineamientos de las empresas y de cómo las victimas están acobijadas por los derechos laborales, además de sentencias analizadas como T-461 de 19988, donde se sitúa una contextualización general del derecho laboral en Colombia.
In recent years the perspective of the violation of fundamental rights has been of constant changes around workplace harassment in women in Colombia, that is why this article has as its main objective to carry out a documentary and jurisprudential analysis on workplace harassment (mobbing) as a violation of the fundamental rights of women in Colombia, through a socio-legal methodology using as a main technique a documentary review on labor charges in Colombia and a legislative documentary legal investigation were improved. Among the results, it is evident from Law 1010 of 2006, the key foundations of workplace harassment in Colombia, its company guidelines and how victims are covered by labor rights, in addition to sentences analyzed as T-461 of 19988, where a general contextualization of labor law in Colombia is located.
