Maternidad subrogada: Análisis desde la perspectiva de un contrato de trabajo en Colombia en el periodo 2012-2024

Resumen
Actualmente, la legislación Colombiana regula muchas de nuestras acciones y
relaciones, desde el medio ambiente hasta la protección integral que ofrece la
seguridad social; sin embargo, existe una notable carencia legislativa respecto a la
práctica de la maternidad subrogada y que consigo conlleva la falta de leyes
específicas en Colombia, profundizando las incertidumbres sobre cómo se debe
manejar laboralmente esta actividad, generando así espacios que podrían
conducir a situaciones de vulnerabilidad o explotación, incidentes que afectan a la
población colombiana más vulnerable, las cuales no podríamos pasar por alto; es
por ello que la presente investigación tiene como objeto general analizar la
maternidad subrogada desde la perspectiva del contrato de trabajo en la
legislación colombiana en el periodo 2012-2024, siendo de gran importancia el
plantear la posibilidad de la aplicación de las características de los contratos de
trabajo a los posibles contratos de maternidad subrogada, en donde se desglose si
la gestante tendría un rol de trabajadora, los comitentes serían los empleadores, y
si la gestación se consideraría una labor formalizada.
La metodología implementada en el transcurso de esta investigación está
soportada desde un enfoque cualitativo, conllevada por un método inductivo, que
parte de la premisa de la observación e identificación de la maternidad subrogada
en Colombia. Además, está orientada por el paradigma histórico-hermenéutico;
siendo el nivel investigativo dado por la tríada descriptivo, propositivo y explicativo;
las técnicas de recolección de la información corresponden a las fuentes
secundarias de análisis documental.
Currently, Colombian legislation regulates many of our actions and relationships, from the environment to the comprehensive protection offered by social security; however, there is a notable legislative gap regarding the practice of surrogate motherhood and that brings with it the lack of specific laws in Colombia, deepening the uncertainties about how this activity should be handled laborly, thus generating spaces that could lead to situations of vulnerability or exploitation, incidents that affect the most vulnerable Colombian population, which we could not overlook; that is why the present research has the general purpose of analyzing surrogate motherhood from the perspective of the labor contract in the Colombian legislation in the period 2012-2024, being of great importance to raise the possibility of the application of the characteristics of labor contracts to possible surrogate motherhood contracts, where it is broken down whether the gestation would have a role of worker, the principals would be the employers, and whether the gestation would be considered a formalized labor. The methodology implemented in the course of this research is supported by a qualitative approach, carried by an inductive method, which starts from the premise of observation and identification of surrogate motherhood in Colombia. In addition, it is oriented by the historical-hermeneutic paradigm; being the investigative level given by the descriptive, propositive and explanatory triad; the data collection techniques correspond to the secondary sources of documentary analysis.
