Resumen
El principio de oportunidad, esa figura legal que, explicada a muy grandes rasgos, permite a las autoridades elegir cuando aplicar el peso de la ley a un infractor de la ley, es una figura que ha existido en Colombia desde una fecha relativamente reciente, y aunque no es propia de nuestra tradición legal, si lo ha sido de los ordenamientos legales occidentales y aquellos que han sido fuertemente inspirados por éstos.
No obstante, éste principio es, como muchas corrientes de pensamiento introducidas aquí, una idea importada poco relacionada con la tradición colombiana y por ende ha tenido sus detractores.
Éste ensayo busca determinar el origen de la figura, su aplicación en los países donde se ha aplicado, una comparación hacia los países donde no se aplica, su introducción y desarrollo en el marco legal colombiano, y qué tanto ha ayudado a la administración de justicia.
The principle of opportunity, that legal figure that, explained in very broad terms, allows the authorities to choose when to apply the weight of the law to a lawbreaker, is a figure that has existed in Colombia since a relatively recent date, and although it is not typical of our legal tradition, it has been typical of Western legal systems and those that have been strongly inspired by them. However, this principle is, like many currents of thought introduced here, an imported idea little related to the Colombian tradition and therefore has had its detractors. This essay seeks to determine the origin of the figure, its application in the countries where it has been applied, a comparison to the countries where it is not applied, its introduction and development in the Colombian legal framework, and how much it has helped the administration of justice.
