Mecanismos de protección jurídica del espacio público: Un estudio comparado de la acción popular, nulidad y restablecimiento del derecho aplicables al Parque Tercer Centenario de Cúcuta

Resumen
La figura del espacio público es un derecho colectivo que no puede ser vulnerado por intereses de algunos pocos, especialmente de profesionales y figuras del escenario local, para crear Corporaciones en lugares históricos. De igual manera, se hizo un estudio comparativo entre la Acción Popular, Nulidad, y Restablecimiento del Derecho entorno al Parque Tercer Centenario de Cúcuta. Para lo cual se desarrollaron los siguientes objetivos específicos como fueron: 1. Identificar los diferentes mecanismos de protección jurídicas
relacionados con el espacio público a nivel nacional. 2. Analizar los pros y contra de la acción popular, nulidad y restablecimiento del derecho a nivel nacional. 3. Describir los efectos jurídicos que se derivarían del proceso que se ha llevado en el caso concreto del Parque Tercer Centenario, en la ciudad de San José de Cúcuta. Bajo una metodología de paradigma interpretativo, con un enfoque cualitativo, junto a un método descriptivo, porque busco detallar todos los aspectos legales, normativos y constitucionales que presentan las diferentes herramientas en defensa de los derechos de la sociedad, en materia colectiva. Se pudo evidenciar, que cada mecanismo presenta sus fortalezas y alguno que otro algo de complejidad que determina su falencia. Asimismo, el Parque objeto de estudio vulneró los derechos de todos los ciudadanos, como lo expresó la Acción Popular
instaurada en el año 2010, como una sociedad sin ánimo de lucro que no era valedera y atenta en pro del patrimonio de la ciudad capital de Norte de Santander.
The right to public space is a collective right that cannot be violated by the interests of a few, especially professionals and local figures, to create corporations in historic sites. Similarly, a comparative study was conducted between the Popular Action, Nullity, and Restoration of Rights regarding the Third Centennial Park in Cúcuta. The following specific objectives were developed: 1. Identify the different legal protection mechanisms related to public space at the national level. 2. Analyze the pros and cons of popular action, nullity, and restoration of rights at the national level. 3. Describe the legal effects that would arise from the process carried out in the specific case of the Third Centennial Park in the city of San José de Cúcuta. Using an interpretive paradigm methodology, with a qualitative approach, along with a descriptive method, I seek to detail all the legal, regulatory, and constitutional aspects presented by the different tools in defense of society's rights in collective matters. It was evident that each mechanism has its strengths and some complexity that determines its weaknesses. Furthermore, the park under study violated the rights of all citizens, as expressed by the Popular Action established in 2010, as a non-profit organization that was not valid and scrutinized the heritage of the capital city of Norte de Santander.
