Resumen
El presente estudio tiene por objeto describir el marco jurídico del abuso sexual de
menores en la ciudad de Barranquilla a partir de la normativa y jurisprudencia aplicable
mediante un análisis descriptivo y de corte cualitativo que permitió dar respuesta a la
pregunta propuesta: ¿Cuál es el panorama jurídico actual del ASM, a partir del desarrollo del
fenómeno en la Ciudad de Barranquilla?; para resolver tal interrogante se atravesaron tres
momentos principales: (i) la identificación de las principales consideraciones en torno a la
protección de los menores frente al ASM a partir del ordenamiento jurídico intern acional, (ii)
la descripción de la normativa a nivel nacional, departamental y distrital, para finalmente (iii)
describir los avances, retos y panorama actual del ASM en la Ciudad de Barranquilla. Se
concluye que la normativa tanto a nivel interno como int ernacional es robusta y se cuentan
con las herramientas jurídicas necesarias para luchar contra el ASM, sin embargo, los avances
en la reducción de los índices de ASM dependen de la correcta implementación de la política
pública que está siendo puesta en m archa para tal menester.
The purpose of this study is to describe the legal framework of sexual abuse of minors in the city of Barranquilla based on the applicable regula tions and jurisprudence through a descriptive and qualitative analysis that allowed us to answer the proposed question: What is the panorama current legal status of the ASM, from the development of the phenomenon in the City of Barranquilla?; To resolve th is question, three main moments were passed: (i) the identification of the main considerations regarding the protection of minors against ASM from the international legal system, (ii) the description of the regulations at the national, departmental level a nd district, to finally (iii) describe the progress, challenges and current panorama of ASM in the City of Barranquilla. It is concluded that the regulations both internally and internationally are robust and there are the necessary legal tools to fight ag ainst ASM, however, progress in reducing ASM rates depends on the correct implementation of the public policy that is being set up for such a need.
