Resumen
En su calidad de Estado Social de Derecho y con fundamento en la democracia que aplica en
el país, el Estado colombiano se rige por principios que apuntan a la igualdad ante la ley, de
todos los habitantes del territorio nacional. En virtud de esa igualdad, de ese derecho a pedir
y derecho al debido proceso, el debate electoral presidencial se enmarca en la atención
específica de los observadores internacionales, atentos siempre a aconteceres en los que se
refleje la calidad de cada nación, en cuanto tiene que ver con su percepción de justicia. Es
esta la base del presente ensayo, en el que se aborda, desde la técnica de la consulta
bibliográfica, el fenómeno de la garantía a los aspirantes a gobernar la nación, en el sentido
de brindar a todos los aspirantes las mismas garantías y restricciones, como elementos
básicos de una elección basada en el querer de los ciudadanos, exclusivamente. En ese
sentido se hace mención a la Ley de Garantías, marco jurídico en el que se inscribe el derecho
de los candidatos y de los ciudadanos, a contar con elecciones equitativas y en las que la
voluntad popular sea el principal ingrediente de un sentir democrático. Se observa cómo, no
obstante las quejas y reclamos de algunos sectores políticos, no se puede hablar de carencia
de garantías o de acciones sesgadas, al menos hasta donde alcanzan las pruebas aportadas
por los denunciantes y quejos.
As a Social State of Law and based on the democracy that applies in the country, the Colombian State is governed by principles that point to equality before the law, of all the inhabitants of the national territory. By virtue of that equality, of that right to request and the right to due process, the presidential electoral debate is framed in the specific attention of international observers, always attentive to events that reflect the quality of each nation, insofar as it has to do with their perception of fairness. This is the basis of this essay, which addresses, from the bibliographical consultation technique, the phenomenon of the guarantee to the aspirants to govern the nation, in the sense of offering all the aspirants the same guarantees and restrictions, as basic elements of an election based on the will of the citizens, exclusively. In this sense, mention is made of the Law of Guarantees, a legal framework in which the right of candidates and citizens is inscribed, to have fair elections and in which the popular will is the main ingredient of a democratic feeling. It is observed how, despite the complaints and claims of some political sectors, one cannot speak of a lack of guarantees or biased actions, at least as far as the evidence provided by the denouncers and complaints reaches.
