La contratación estatal en el marco de la pandemia producida por el COVID – 19 en Colombia

Resumen
Con la aparición de la pandemia producida por el virus denominado COVID-19, gran parte del planeta se vio obligado a modificar muchos aspectos de la cotidianidad y Colombia no fue la excepción. A partir del momento en el que se tuvo conocimiento de la entrada del virus al país y del pronunciamiento por parte de la Organización Mundial de la Salud – OMS, en el cual se declaraba la pandemia producida por el virus, el Gobierno Nacional promulgó el Decreto 417 de 2020, mediante el cual se declaró el Estado de Emergencia Económica, Social y Ecológica en el territorio nacional. A partir de dicha declaratoria se ordenaron algunas modificaciones tanto a la infraestructura tecnológica como a la forma de realizar las actividades dentro de la pandemia; adicional a ello, se otorgó cierta flexibilidad a las entidades públicas para que adicionaran bienes y servicios en los contratos que celebraran, sin ninguna limitación. El objetivo principal del presente artículo de reflexión es analizar la contratación estatal que se realizó en Colombia dentro del marco de la pandemia causada por el COVID-19, llegando a la conclusión de que el flagelo de la corrupción no solo está afectando cualquier estamento de la sociedad, sino que, además, en la práctica no se observan actos que busquen, realmente, eliminar dicho actuar antijurídico.
With the appearance of the pandemic produced by the virus called COVID-19, a large part of the planet was forced to modify many aspects of daily life and Colombia was no exception. From the moment in which the virus entered the country and the pronouncement by the World Health Organization - WHO, in which the pandemic caused by the virus was declared, the National Government promulgated the Decree 417 of 2020, by which the State of Economic, Social and Ecological Emergency was declared in the national territory; As of this declaration, some modifications were ordered both to the technological infrastructure and to the way of carrying out activities within the pandemic; In addition to this, certain flexibility was granted to public entities to add goods and services in the contracts they entered into, without any limitation; As a result, there were a series of complaints that evidenced an alleged alteration in the prices of some goods and services, a situation that demonstrated the corruption that was taking place in these entities. The main objective of this reflection article is to analyze the state contracting that was carried out in Colombia within the framework of the pandemic caused by COVID-19, reaching the conclusion that the scourge of corruption is not only affecting any sector of the society, but, in addition, in practice there are no acts that really seek to eliminate said unlawful act.
