Resumen
El presente artículo, en el análisis de los avances de la actual legislación, en lo referente a la protección y al bienestar de los animales, mediante la entrada en vigor de la ley “contra el maltrato animal”, como un tema tan viral en la primera década del siglo actual, con el acceso a las redes sociales, el que cualquier persona, pueda grabar desde su móvil, los hechos reprochables, donde los animales son blanco fácil de la crueldad humana, esto llevo a los legisladores de los países democráticos, a sancionar, perseguir reprochar y castigar las faltas contra los animales.
Cabe resaltar que nuestra legislación, aborda este tema desde la premisa que los Animales no son sujetos de derechos, pero que si son sujetos de protección y consideración, por parte de la sociedad, que en su mayoría no está de acuerdo con ningún acto de crueldad contra los animales, sin importar la especie, a lo anterior nuestra legislación a través de esta norma, les quito el estigma de ser considerados cosas y les dio el estatus de ser seres sintientes, por tanto consideraremos este trabajo, como el reconocimiento a las sociedades como la nuestra que en unanimidad, creó y propicio los mecanismos para garantizarles a nuestros animales (fauna silvestre y domestica), el bienestar y especial consideración por ser la especie humana, especie dominante y responsable de su protección.
This article, in the analysis of the progress of our legislation, in relation to the protection and welfare os animals, through the entry into force of the law “against animal abuse”, as a viral issue in the first decade of the current century, eith access to social networks, that anyone can record from their mobile, the reproachanble facts, where animals are easy targets of human cruelty, this led tothe lesgistors of democratic conutries. To sanction, pursue reproach and punish faults against animals. It should be noted that our legilation, addresses this issue from the premise that Animals are not subjects of rights, but that if they are subjects of protection and consideration, by society, that mostly do not agree with any act of cruelty against animals, regardless of the species, to the above our legislation took away the status of being sentient beings, therefore we will consider this work, as the recognition of societies like ours that unanimously, I believe and propitiate the mechanisms to guarantee ouranimals (Wildlife and domestic fauna), the well-being and special consideration for being the human species the dominant and responsab le for their protection.
