La acción de cumplimiento: el mecanismo efectivo para la protección colectiva del ambiente como ente sujeto de derecho en Cúcuta

Resumen
Este escrito constituye el producto logrado mediante el ejercicio investigativo del presente equipo de trabajo, sobre el ambiente como un sujeto de derecho y su protección a nivel general por medio de la acción de cumplimiento, el mecanismo constitucional más idóneo para dicha tarea, con delimitación en la ciudad capital San José de Cúcuta. Los objetivos principales planteados para esta investigación fueron: I) identificar la normatividad existente para la conservación del ambiente y asimismo la acción de cumplimiento, II) Reconocer las acciones de cumplimiento resueltas por el Consejo de Estado en el periodo de 2017 hasta 2019 y finalizando III) Cuál es la efectividad de la acción constitucional de cumplimiento para amparar los derechos al ambiente. En este sentido, la actuación científica fue desarrollada de acuerdo con un paradigma interpretativo, aunado al enfoque cualitativo, con método hermenéutico, dada la naturaleza comprensiva y profundizadora que el proyecto involucró. De acuerdo a dicha estructura, surgieron dos matrices distintas, cada una correspondiente a uno de los objetivos enunciados, donde se sintetizó toda la información pertinente recolectada, con su respectivo análisis social y/o jurídico. Siendo así, el presente documento permite entender dinámicas socio jurídico, existente al interior del contexto municipal cucuteño, en cuanto al medio ambiente, abordando finalmente la efectividad producida por la acción de cumplimiento, como mecanismo plasmado constitucionalmente para la salvaguarda colectiva de aquel, percibido como sujeto de derecho.
This writing is the product achieved through the investigative exercise of this work team, on the environment as a subject of law and its protection through compliance action, the most suitable constitutional mechanism for this task, with delimitation in the city capital San José de Cúcuta. The main objectives set for this research were: I) Identify the existing regulations on environmental protection and compliance action, II) Recognize compliance actions resolved by the Council of State in the period from 2017 to 2019, III) How effective the compliance action has been for environmental protection. In the sense, the scientific activity was developed according to an interpretive paradigm, together with the qualitative approach. With the hermeneutic method, the comprehensive nature and the deepening of the project involved. According to this structure, two matrices emerged, each the stated objectives, where all the pertinent information collected was synthesized, with its respective social and legal analysis. This being so, this document allows us to understand socio-legal dynamics, the interior of the municipal context of Cúcuta, in the environment, the treatment, finally, the one held by the compliance action, as the constitutional mechanism for the collective protection of the one, perceived as a subject of law.
