Resumen
El presente artículo de investigación tuvo como finalidad abordar una problemática social que durante mucho tiempo ha pasado desapercibida sin que se haya tomado en cuenta por tratarse de animales, los cuales también cumplen un ciclo de vida al igual que el resto de seres humanos, entendiéndose como maltrato animal aquella crueldad injustificada que causa daño y sufrimiento a los animales. Este fenómeno se ha incrementado con el paso del tiempo sin que se le dé el trato o la importancia necesaria, he aquí la importancia que se le debe dar a este tema, ya que no solo afecta directamente a los animales, puesto que muchos estudios han determinado que existe una gran relación entre la violencia en contra de los animales y la violencia contra las personas. Se quisieron determinar los factores y/ causas, así como las consecuencias del este fenómeno del maltrato animal. A su vez se realizó una revisión normativa legal vigente que se ha adoptado en Colombia para combatir esta problemática. Se plantea una metodología de carácter socio-jurídico de tipo investigativo, estructurada en cuatro capítulos, basados en una revisión documental investigativo descriptiva, comenzando con definiciones básicas y el análisis de fuentes relacionadas con el tema investigado, enfocando en la búsqueda de factores y ámbito de la normativa nacional vigente, así como fuentes de carácter internacional para establecer un marco del ordenamiento jurídico que rige la materia y así poder determinar el ámbito de aplicación de la Ley 1774 de 2016
The present research article aimed to address a social problem that has long gone unnoticed without being taken into account because they are animals, which also fulfill a life cycle like the rest of human beings, understood as animal abuse that unjustified cruelty that causes harm and suffering to animals. This phenomenon has increased with the passage of time without being given the treatment or the necessary importance, here is the importance that should be given to this topic, since it not only directly affects the animals, since many studies have determined that there is a strong relationship between violence against animals and violence against people. We wanted to determine the factors and causes, as well as the consequences of this phenomenon of animal abuse. In turn, a current legal regulatory review was carried out in Colombia to combat this problem. A socio-juridical methodology of investigative nature is proposed, structured in four chapters, based on a descriptive investigative documentary review, starting with basic definitions and the analysis of sources related to the investigated topic, focusing on the search of factors and scope of research. current national regulations, as well as international sources to establish a legal framework that governs the matter and thus determine the scope of application of Law 1774 of 2016
