Resumen
En el siguiente artículo se trata de explicar la construcción jurídica y normativa en relación a los Derechos Humanos de los migrantes como sujetos de especial protección por el derecho internacional humanitario, en especial, el derecho a la vida, salud , vida digna y educación que son pilares fundamentales de cualquier ser humano, para lo que se llevara a cabo un estudio a partir del análisis exhaustivo del marco jurídico y de igual manera comparativo de las dinámicas fronterizas Colombia- Venezuela y México- Estados Unidos en donde son las fronteras de América con mayor flujo de migrantes a través de los límites fronterizos , en lo que haremos referencia a los diseños normativos, político y sociales de cada una de estas fronteras, teniendo como pilar principal las obligaciones que contrajeron al momento de ratificar los tratados internacionales de protección de los Derechos humanos firmados dichos Estados los que los hacen velar por la protección y cuidado de los derechos de los migrantes y, en particular, aquellas normas de rango internacional que protege y garantiza los derechos de los migrantes como personas en condición de movilidad humano o personas en necesitad de protección internacional lo que acentúa aún más las protección de estos sujetos por parte de estos estados de los que se hará especial estudio en la condición de ayuda que reciben los migrantes al momento de cruzar las fronteras en búsqueda de una mayor y mejor condición y calidad de vida
The following article tries to explain the legal and normative construction in relation to the Human Rights of migrants as subjects of special protection by international humanitarian law, especially, the right to life, health, dignified life and education that are fundamental pillars of any human being, for which a study will be carried out from the exhaustive analysis of the legal framework and of the same comparative way of the border dynamics Colombia-Venezuela and Mexico-United States where are the borders of America with greater flow of migrants across the border, in which we will refer to the normative, political and social designs of each of these borders, having as main pillar the obligations they contracted at the time of ratifying the international treaties for the protection of human rights. signed these states those that make them watch over the protection and care of the e the rights of migrants and, in particular, those standards of international rank that protect and guarantee the rights of migrants as persons in conditions of human mobility or persons in need of international protection, which further accentuates the protection of these subjects by part of these states of which special study will be made on the condition of help received by migrants when crossing borders in search of a greater and better condition and quality of life
