Resumen
Introducción. Con el propósito de garantizar a los animales una especial protección e impedirles padecimientos y dolores en ocasiones generados por los hombres, se ha buscado su defensa y protección y esta ha sido asunto de interés mundial consiguiendo involucrar a diferentes países para lograr hacer efectiva una legislación que los proteja y poder ejecutar acciones de cumplimiento; se tuvo en cuenta especialmente países latinoamericanos como Colombia, México y Perú. Objetivo. Realizar un análisis jurídico y comparar las formas como se ha legislado en torno a la protección animal en otros sistemas jurídicos de países latinoamericanos como México y Perú, respecto al caso colombiano. Metodología. Se realizó una investigación tipo jurídico de corte cualitativo- hermenéutico. Resultados. Las normas contempladas en los países de Latinoamérica incluyendo a Colombia respecto al caso de la protección de los animales consideran algunas conductas humanas como sancionables debido a que los animales se encuentran en condiciones de indefensión y puede llevar a lesionarlos u ocasionarles la muerte a los mismos. Conclusión. Esta normatividad resulta necesaria e importante ya que concientiza e impone responsabilidades a las personas que trabajan con ellos o les gustan estableciendo medidas para cualquier clase de abuso o de abandono que se pueda presentar que en reiteradas ocasiones son sometidos los animales, como seres vivos que son requieren de especial cuidado y protección
Introduction. With the purpose of guaranteeing the animals a special protection and to prevent them suffering and pain in occasions generated by men, their defense and protection has been sought and this has been a matter of worldwide interest getting to involve different countries to achieve effective legislation that protect them and be able to execute enforcement actions; We will especially take into account Latin American countries such as Colombia, Mexico and Peru. Objective. Carry out a legal analysis and compare the ways in which animal protection has been legislated in other legal systems of Latin American countries such as Mexico and Peru, with respect to the Colombian case. Methodology. A qualitative-hermeneutic type of legal investigation was carried out. Results. The norms contemplated in the countries of Latin America including Colombia regarding the case of the protection of animals consider some human behavior as punishable because the animals are in defenseless conditions and can lead to injury or death to them. Conclusion. This regulation is necessary and important because it raises awareness and imposes responsibilities on people who work with them or like to establish measures for any kind of abuse or abandonment that may arise that animals are repeatedly subjected to, as living beings that are they require special care and protection
