Resumen
Se realizó un estudio sobre los efectos que tuvo durante el año 2017 en los Juzgados Civiles Municipales de Cúcuta la aplicación de las diferentes novedades del Código General del Proceso, para lo cual se hizo revisión del concepto del derecho fundamental de acceso a la administración de justicia y posteriormente con base a él se investigó la forma en que se planteó esta normativa como una reforma estructural con el objetivo de mejorar la capacidad de respuesta del Poder Judicial frente a las necesidades y falencias que venía presentando el sistema, entrevistando a los protagonistas de la actividad judicial desde ambas barreras del estrado sobre sus opiniones en materia de efectos positivos, dificultades y proposición de soluciones, con la finalidad de identificar aquellos cambios que han permitido mejorar la materialización del derecho fundamental de acceso a la administración de justicia así como las problemáticas que persisten pese a los cambios sustanciales del procedimiento. Con un ejercicio paralelo de consulta y observación de la actividad diaria de los despachos judiciales, siendo estos donde se desarrolla el derecho material y cercano a los ciudadanos, de las respuestas provistas en las entrevistas de donde se desprendieron inconformidades se buscó hacer recomendaciones prácticas y precisas para mejorar los resultados de los Juzgados del circuito de Cúcuta con base a las nuevas medidas del Código General del Proceso, identificando aquellas que se establecieron por parte del legislador como las más necesitadas para posteriormente verificar si efectivamente ha sido bien recibida por los funcionarios y usuarios del sistema, de manera que se establezca una alternativa a tener en cuenta y que permita mejorar el acceso a una justicia eficaz, efectiva y célere
A study was carried out on the effects that the application of the different novelties of the General Process Code had during the year 2017 in the Municipal Civil Courts of Cúcuta, for which the concept of the fundamental right of access to the administration of justice was reviewed and then based on it, the way in which this regulation was raised as a structural reform was investigated with the objective of improving the capacity of the Judicial Branch to respond to the needs and shortcomings that the system had been presenting, interviewing the protagonists of the judicial activity from both barriers of the podium about their opinions on positive effects, difficulties and proposal of solutions, in order to identify those changes that have made it possible to improve the materialization of the fundamental right of access to the administration of justice as well as the problems that persist despite substantial changes in the proc edimiento. With a parallel exercise of consultation and observation of the daily activity of the judicial offices, being these where the material right is developed and close to the citizens, from the answers provided in the interviews where disagreements were uncovered, we sought to make practical and precise recommendations to improve the results of the Courts of the circuit of Cúcuta based on the new measures of the General Process Code, identifying those that were established by the legislator as the most needed to subsequently verify whether it has been well received by officials and users of the system, in order to establish an alternative to be taken into account and to improve access to effective, effective and fair justice
