Resumen
La tipificación del feminicidio como delito autónomo del homicidio en la legislación colombiana, ha generado que en el momento en que se investiga la muerte de una mujer, el operador judicial deba estudiar y analizar el contexto, y los hechos en los que se desarrolló esa muerte, para de esta manera tipificar adecuadamente la conducta punible, y así contribuir a la recta y eficaz administración de justicia.
Al existir dos tipos penales que sancionan con una pena a quien atente o acabe con el bien jurídicamente tutelado de la vida en una mujer, debe existir claridad respecto de los elementos que configuran cada uno de los tipos penales, por lo tanto con la presente investigación se busca principalmente analizar los elementos de la tipicidad, que diferencian el delito de feminicidio del homicidio en Colombia, para así establecer claramente los aspectos en los que se diferencian estos dos delitos, incluyendo la tipicidad objetiva y la subjetiva, para posteriormente a través del estudio de sentencias proferidas en procesos penales determinar las consideraciones que tienen los jueces para tipificar un caso como feminicidio y homicidio.
La metodología escogida para desarrollar los objetivos de la presente investigación se dio bajo un enfoque cualitativo, utilizando la técnica documental; en los resultados se pudo establecer que en cuanto a la tipicidad objetiva y subjetiva del feminicidio y homicidio en Colombia, los factores subjetivos dan a grandes rasgos la principal diferencia en estos dos tipos penales, pues cuando el crimen contra la vida de una mujer, se da por la aversión, discriminación o desprecio que se siente hacia ellas por su condición de ser mujer o por razones de género, se está en presencia de un feminicidio, mientras que el homicidio, únicamente requiere que se haya acabado con la vida de una mujer sin motivación especifica de odio.
The typification of femicide as an autonomous crime of homicide in Colombian legislation has generated that at the moment in which the death of a woman is investigated, the judicial operator must study and analyze the context, and the events in which that death took place. The methodology chosen to develop the objectives of this research was based on a qualitative approach, using the documentary technique; In the results, it could be established that in terms of the objective and subjective typicity of feminicide and homicide in Colombia, the subjective factors give a broad outline of the main difference in these two criminal types, since when the crime against the life of a woman is It is due to the aversion, discrimination or contempt felt towards them by their condition of being a woman or because of gender reasons, they are in the presence of feminicide, whereas homicide only requires that a woman's life has been ended no specific hate motivation
