Para lograr este objetivo, se utiliza un método hermenéutico desde diferentes corrientes del derecho como el iusnaturalismo e ius-positivismo para analizar el recorrido histórico-filosófico de la noción de derecho innominado, además, del razonamiento jurídico en la sistematización de ciertas facultades jurídicas no positivizadas por parte de los precedentes de la Corte Constitucional colombiana, mediante la ponderación de principios constitucionalesThis paper discussion is assumed about the notion of the innominate fundamental rights, starting from his foundation epistemology in terms of the nature of a person and his relationship with those rights inherent to the human being, that a hold a direct relationship with his own dignity, which helps to identify a direct axiology with the natural law and the transformation to a human right through the different revolutions that occurred during the modern age.
