El objetivo principal es evidenciar cómo esta campaña pública afecta a una población vulnerable, como lo es el gremio de los carro muleros, y contribuir a la comprensión de los derechos fundamentales constitucionales que se les estarían vulnerando. Tenemos que saber que este decreto lo que proyecta es remplazar estos animales de carga por un automotor, el cual tendría algunos temas en los que muchas personas pertenecientes al gremio de carro muleros tendrían dificultades, teniendo en cuenta que un automotor necesita de muchas cosas para su sostenimiento, como son combustible, pólizas, licencias y demás partes mecánicas que se deben llevar con cuidado para el sostenimiento del automotor a través de los años. Que esta herramienta de trabajo que les seria entregada a estas personas con el paso del tiempo no vaya a tener problemas, y no poder hacer un buen uso de este, el que sería para su sostenimiento como una herramienta de trabajo efectiva. También en como este afectaría la economía de este gremio el cual tendrían que empezar a preocuparse cuando llegue el momento de renovar ciertos documentos (Soat, Tecno mecánica, licencia de conducir, impuestos, etc.), y que, si al momento de renovarlos no tenga la capacidad económica, estos no podrían salir por las calles a ejercer su labor libremente como lo vienen haciendo con su semoviente. Asimismo, se aborda la calidad de vida que recibirán los semovientes (animales de carga) una vez sean entregados a la alcaldía, y cómo esta entidad gestionará su bienestar mediante campañas de adopción para los semovientes. Y es que estos animales son un beneficio para el medio ambiente, y específicamente en como su excremento puede ser bien utilizado como fertilizante, en el que este, es muy rico para darles los nutrientes necesarios a las plantas para su crecimiento y tener una resiliencia de los ecosistemas el cual nos brindan más oxígeno. También examina cómo otras administraciones han implementado esta política pública, evaluando su efectividad en la mejora de la calidad de vida tanto de los carro muleros como de los animales, teniendo en cuenta como la Corte Constitucional a través de sus sentencias acobija al gremio para que estos hagan un goce efectivo de sus Derechos Fundamentales Constitucionales. Finalmente, el proyecto contempla una ponderación de Derechos, con el fin de identificar los Derechos vulnerados y cual tendría mayor prevalencia, al entender todo el entorno que conlleva a tal situación y tener una mejor óptica del tema al momento de argumentar sobre este, el cual está teniendo unas etapas que no han sido de una manera efectiva para las partes intervinientes en toda esta campaña que se empieza a desenvolver para llevar a cabo todo el retiro del gremio de carro muleros. Es de vital importancia que a través de esta campaña se deben llevar unos lineamientos lo cuales se tienen que cumplir a cabalidad para que esta pueda ser implementada en su totalidad, evitando que su promulgación afecte directamente los Derechos Fundamentales de las partes involucradas.This study analyzes the impact of the ban on animal-drawn vehicles in Barranquilla, focusing on its social, economic, and environmental implications. The main objective is to demonstrate how this public campaign affects a vulnerable population, such as the muleteer-cart drivers' union, and to contribute to an understanding of the fundamental constitutional rights that are being violated. We must be aware that this decree aims to replace these pack animals with motor vehicles, which would pose some challenges for many members of the muleteer-cart drivers' union. Considering that a motor vehicle requires many things for its maintenance, such as fuel, insurance policies, licenses, and other mechanical parts that must be carefully maintained to maintain the vehicle over the years, we hope that this work tool, which would be given to these people over time, will not have problems and will not be able to make good use of it, which would be necessary for its maintenance as an effective work tool. They would also have to start worrying about how this would affect the economy of this sector when it comes time to renew certain documents (Soat, Mechanical Technology, driver's license, taxes, etc.). If they don't have the financial means to renew them, they wouldn't be able to freely walk the streets and carry out their work as they have been doing with their livestock. Likewise, the quality of life that the livestock (pack animals) will receive once they are handed over to the mayor's office is addressed, as well as how this entity will manage their well-being through adoption campaigns for them. These animals are a benefit to the environment, specifically how their excrement can be used as fertilizer, which is very rich in providing the necessary nutrients for plants to grow and fostering ecosystem resilience, which provides us with more oxygen. It also examines how other administrations have implemented this public policy, evaluating its effectiveness in improving the quality of life of both mule drivers and their animals, taking into account how the Constitutional Court, through its rulings, supports the union so that they can effectively enjoy their Fundamental Constitutional Rights. Finally, the project contemplates a weighing of rights, in order to identify the rights violated and which would have the greatest prevalence, by understanding the entire context leading to such a situation and gaining a better understanding of the issue when arguing about it. This issue is currently going through stages that have not been effective for the parties involved in this entire campaign that is beginning to unfold to carry out the withdrawal of the mule drivers' union.
