Para ello se toma un marco referencial que involucra investigaciones previas realizadas principalmente por el Observatorio Feminicidios Colombia de la Red Feminista Antimilitaristas; para el análisis se tuvo en cuenta el contenido de las Convenciones de Belem Do Pará y la CEDAW, la Declaración y Plataforma de Acción de Beijín de 1995, así como la legislación interna en lo referente a la Ley 1257 de 2008; desde este cuadro normativo se revisa la responsabilidad estatal frente a la garantía que debe tener la mujer para vivir una vida libre de violencia y discriminación. A partir de los resultados se concluye que las mujeres del departamento del Atlántico y de todo el país no cuentan con las garantías estatales que las liberen de una violencia que tiene raíces culturales de carácter patriarcal y machista. Igualmente se determinó que la practica feminicida en el Atlántico y resto del país tiene un corte de crimen atroz, en donde la crueldad y la sevicia están presentes.This article is a necessary response to visualize the responsibility and response of the Colombian State to the issue of femicide, having the department of Atlántico as a territorial framework. For this, a referential framework is taken that involves previous investigations carried out mainly by the Colombian Feminicide Observatory of the Antimilitarist Feminist Network; for the analysis, the content of the Conventions of Belem Do Pará and CEDAW, the Declaration and Platform for Action of Beijing of 1995, as well as the internal legislation in relation to Law 1257 of 2008 were taken into account; from this normative framework State responsibility is reviewed in relation to the guarantee that women should have to live a life free of violence and discrimination. Based on the results, it is concluded that women in the department of Atlántico and throughout the country do not have state guarantees that free them from violence that has cultural roots of a patriarchal and sexist nature.
