Mediante un enfoque cualitativo interpretativo, se analizan la Ley 985 de 2005, el Código Penal y el Protocolo de Palermo, evaluando su eficacia en la prevención, sanción y asistencia a las víctimas. Los hallazgos revelan que, aunque el marco legal ha avanzado hacia estándares internacionales, persisten problemas como falta de recursos, corrupción y limitada coordinación entre instituciones. Se concluye que es necesario fortalecer estos aspectos para ofrecer una protección efectiva y sostenida a los NNA frente a estos delitos.This study examines the legal mechanisms in Colombia to protect children and adolescents (NNA) against human trafficking and smuggling, with special emphasis on their vulnerability in areas of high migration such as Norte de Santander. Through a qualitative interpretative approach, Law 985 of 2005, the Penal Code and the Palermo Protocol are analyzed, evaluating their effectiveness in prevention, punishment and assistance to victims. The findings reveal that, although the legal framework has advanced towards international standards, problems such as lack of resources, corruption and limited coordination between institutions persist.
