La jurisdicción especial para la paz como mecanismo judicial idóneo para materializar los derechos de paz, verdad, justicia, reparación y no repetición

Resumen
El presente ensayo aborda la creación de la Jurisdicción Especial para la Paz y el cómo trae consigo un nuevo enfoque, mucho más restaurativo, premiando la verdad, la reparación y buscando las garantías de no repetición, aunque claro, en una sociedad como la colombiana, en la cual persiste una serie de problemas culturales pues el ciudadano de a pie está acostumbrado y exige unas penas altas para las personas que cometen delitos y mucho más cuando son en el marco del conflicto armado; y así como la votación del plebiscito para la paz polarizo a todo el país, este Tribunal promete lo mismo.
A partir de un análisis normativo, se podrá tratar y analizar los principios sobre los cuales se fundamenta esta jurisdicción y como su finalidad no es otra que buscar la verdad, la justicia, la reparación y no repetición en el marco de un conflicto armado que ha durado más de 60 años entre las extintas Farc-EP y el Estado colombiano.
This article addresses the legal concept of pre-agreements within the Colombian accusatory criminal system, in application of the negotiations as a punitive response under contemporary criminal law, incorporating in turn the relationship that this legalprocedural concept has with the victims and the correct administration of justice, in the understanding that victims as subjects of rights and protection in the accusatory criminal system must have a connotation consistent with their imminent importance as the pillars of the Social State of Law (ESDD), in which it must care for and exalt, safeguarding the constitutional principles that serve as a foundation for its permanence and support. The foregoing has been obtained in the present investigation, based on the analysis carried out regarding the criteria of the jurisprudence of the Honorable Supreme Court of Justice. For this, an investigation with a qualitative paradigm was used, under a hermeneutic approach, and a bibliographic design, through which through documentary analysis and analyticalsynthetic processing, under the following indicators: a) Correct administration of justice, b ) Rights and interests of victims in Colombia, c) Pre-agreements in the Colombian Penal System and d) Presuppositions of the sentence, it was possible to observe that there are essential presuppositions that prosecutors must consider when making agreements with the defendant, since there are certain rules that must be taken into account in accordance with the functions and responsibilities given by the constitution and the norm, to avoid legal contradiction and violation of the rights to justice of the victims in the criminal process.
