Resumen
Este proyecto de investigación plantea un análisis socio-jurídico del trabajo decente de trabajadores formales de Barranquilla, Colombia, año 2023, tiene como punto de partida los estándares adoptados por la Organización Internacional del Trabajo y del ordenamiento jurídico en Colombia. Entendiendo la noción de trabajo decente como categoría jurídico-social ligadas estrechamente con la dignidad humana, justicia social, igualdad, protección social, y la garantía en condiciones laborales dignas y justas, que brinden seguridad en el empleo. Este enfoque, plantea un acercamiento crítico entre el estándar normativo y el contexto actual. Respecto al plano metodológico, abarca un enfoque cualitativo, método inductivo y paradigma interpretativista, por tratarse de la necesidad de comprender el fenómeno desde las experiencias, percepciones y condiciones reales en el empleo. Esta investigación se alinea para verificar el contenido normativo con las dinámicas sociales y los postulados jurídicos que envuelven la materialización del derecho al “trabajo decente” como garantía en el mundo del trabajo. Se fundamenta en referentes doctrinantes, normativos y jurisprudenciales que nos llevan a enfatizar su contenido, como medición del análisis.
This research project proposes a socio-legal analysis of decent work for formal workers in Barranquilla, Colombia, in the year 2023. Its starting point is the standards adopted by the International Labor Organization and the legal system in Colombia. Understanding the notion of decent work as a legal-social category closely linked to human dignity, social justice, equality, social protection, and the guarantee of decent and fair working conditions that provide job security. This approach raises a critical approach between the regulatory standard and the current context. Regarding the methodological level, it encompasses a qualitative approach, inductive method and interpretivist paradigm, as it deals with the need to understand the phenomenon from experiences, perceptions and real conditions in employment. This research is aligned to verify the normative content with the social dynamics and legal postulates that surround the materialization of the right to “decent work” as a guarantee in the world of work. It is based on doctrinal, normative and jurisprudential references that lead us to emphasize its content, as a measurement of the analysis. This work is limited to the legal problem of the effectiveness and efficiency of the labor rights of workers in Barranquilla, formality in employment, social protection, equality, and the State as guarantor in the consolidation of decent and fair conditions, with national and international guidelines for employment protection.
