Resumen
La migración originada en Venezuela creó una crisis humanitaria de gran escala en Colombia, en la que los adultos mayores hacen parte de un colectivo poblacional en
condiciones de desprotección dentro de la sociedad. Esta investigación tiene como finalidad analizar la efectividad de la facultad jurídica en materia de la salud en adultos
mayores migrantes en zonas de frontera, en el marco del sistema jurídico colombiano e instrumentos internacionales relacionados con derechos humanos. Por medio de una
metodología cualitativa de carácter documental, se examina la normatividad nacional, decisiones emitidas por la Corte Constitucional y el impacto del Estatuto Temporal de
Protección. Del mismo modo, se evidencian e identifican barreras estructurales, administrativas, culturales y sociales que dificultan el acceso efectivo a servicios de
salud, principalmente en territorios como La Guajira y Norte de Santander, donde la infraestructura y las acciones del Estado son limitadas en aras de generar un progreso.
El estudio presenta una desconexión entre la norma y su aplicación en la realidad, es decir, en la práctica, lo cual vulnera principios tales como: la dignidad humana, el valor
rector de igualdad y la ausencia de exclusión. El resultado o conclusión del escrito se enfoca en que, a pesar de los avances normativos, se mantiene una brecha que afecta
la garantía de las prerrogativas básicas de esta población. Por último, se plantea un enfoque interseccional en las políticas públicas que considere las condiciones de edad,
territorio y migración.
The migration originating in Venezuela created a large-scale humanitarian crisis in Colombia, in which older adults are part of a population group that is vulnerable within society. The purpose of this research is to analyze the effectiveness of legal authority in matters of health for older adult migrants in border areas, within the framework of the Colombian legal system and international instruments related to human rights. Using a qualitative documentary methodology, it examines national regulations, decisions issued by the Constitutional Court, and the impact of the Temporary Protection Statute. Similarly, structural, administrative, cultural, and social barriers that hinder effective access to health services are identified, mainly in territories such as La Guajira and Norte de Santander, where infrastructure and state actions are limited in terms of generating progress. The study reveals a disconnect between the law and its application in reality, that is, in practice, which violates principles such as human dignity, the guiding value of equality, and the absence of exclusion. The result or conclusion of the paper focuses on the fact that, despite regulatory advances, a gap remains that affects the guarantee of the basic rights of this population. Finally, it proposes an intersectional approach to public policies that takes into account age, territory, and migration.
