Resumen
La investigación se enfoca, en la Garantías Jurídicas en el proceso disciplinario en empresas privadas en relación con la reforma laboral en Colombia 2024-2025
realizando un análisis de la normativa, doctrina y jurisprudencia de este proceso.
Se realizará una encuesta semiestructurada para conocer la percepción de los trabajadores de una empresa privada en la ciudad de Barranquilla, la cual será objeto de tabulación y análisis para el desarrollo de los objetivos de la investigación, donde las apreciaciones de los actores sociales hacen reflejar las realidades del proceso disciplinarios de las empresas privadas en Colombia.
Se espera poder realizar un diagnóstico jurídico integral, sobre el tema propuesto en esta líneas, para ello se empleará la investigación jurídica tradicional aplicada, con un enfoque mixto, cualitativo y cuantitativo, en el primer caso se analizaran las conceptos objeto de análisis, determinando sus particularidades más importantes, para describir los nexos entre ella, utilizando el método deductivo, cuando se hace el razonamiento para lograr conclusiones a partir de hechos o fenómenos particulares que se consideran válidos, y a partir de ahí se logran conclusiones generales, con el fin de sugerir cambios, si son necesarios o reformar los aspectos benéficos que finalmente se encuentren.
Para finalizar con el exordio el presente trabajo especial de grado el cual es construido en razón del estudio de las relaciones de trabajo del sector privado, establecidos desde el establecimiento de normas anteriores a la aplicación del proceso disciplinarios y que podía traer consigo despedidos injustificados por lo que se estaría ante la trasgresión o vulneración de los principios laborales consignados en las normas jurídicas desde la constitución, ley, decretos y jurisprudencia, es así que este producto de investigación está conformado por el planteamiento del problema, objetivos, justificación, metodología, marco referencial, entrevista, resultados, discusión de resultados, consolaciones, recomendaciones, bibliografía y anexos.
This research focuses on the legal guarantees in disciplinary proceedings in private companies in relation to the 2024-2025 labor reform in Colombia, conducting an analysis of the regulations, doctrine, and jurisprudence of this process. A semi-structured survey will be conducted to understand the perceptions of employees at a private company in the city of Barranquilla. The data will be tabulated and analyzed to achieve the research objectives, as the perceptions of the social actors reflect the realities of disciplinary proceedings in private companies in Colombia. It is hoped that a comprehensive legal diagnosis can be carried out on the topic proposed herein. To this end, traditional applied legal research will be employed, using a mixed-methods approach, both qualitative and quantitative. In the first instance, the concepts under analysis will be examined, determining their most important characteristics, in order to describe the connections between them. The deductive method will be used, reasoning from specific facts or phenomena considered valid, and from there, general conclusions will be drawn, with the aim of suggesting changes, if necessary, or reforming the beneficial aspects that are ultimately identified. To conclude the introduction, this special degree project, which is based on the study of labor relations in the private sector, established since the implementation of regulations prior to the application of disciplinary processes, which could lead to unjustified dismissals, thus representing a transgression or violation of labor principles enshrined in legal norms such as the constitution, laws, decrees, and jurisprudence, is comprised of the problem statement, objectives, justification, methodology, reference framework, interviews, results, discussion of results, conclusions, recommendations, bibliography, and appendices.
