Resumen
El derecho de petición, conforme la Carta Magna/1991, constituye un mecanismo de comunicación entre la administración pública y la ciudadanía, cuya efectividad depende del cumplimiento de los términos de ley, articulándose con los principios que regulan la función administrativa, específicamente la celeridad, para garantizar actuaciones eficientes y exentas de omisiones injustificadas.
La investigación analizó la aplicabilidad del principio de celeridad en la atención del derecho de petición en la Oficina de Talento Humano de la Alcaldía de Cúcuta del año 2024, evaluando si los tiempos de respuesta se ajustan a los términos legales, verificando posibles limitaciones administrativas que influyen extemporáneamente o la ausencia de contestación.
Metodológicamente implementó un enfoque cualitativo, con paradigma sistemático, un diseño analítico-descriptivo examinando la gestión de las peticiones, utilizando técnicas de análisis documental, revisando marco normativo y jurisprudencial aplicable y los registros institucionales de radicación y respuestas, mediante esquemas comparativos entre los términos legales y los tiempos de respuesta del 2024.
Los resultados evidenciaron que, aunque la mayoría de las peticiones fueron atendidas dentro del término legal, persisten respuestas extemporáneas y solicitudes sin atención, reflejando debilidades en el seguimiento de una administración. La sobrecarga, la dificultad de diversos trámites y falta de articulación interna influyen en su naturaleza principal, afectando el ejercicio del derecho de petición, conllevando a la interposición de tutelas. En conclusión, la aplicación del principio en el 2024 fue parcial e insuficiente, demostrando la necesidad de fortalecer los procesos, mejorar la gestión y consolidar el cumplimiento normativo, bajo sus principios rectores (Eficacia, Celeridad).
The right to petition, as established by the 1991 Constitution, constitutes a communication mechanism between the public administration and citizens. Its effectiveness depends on compliance with legal deadlines and is linked to the principles governing administrative functions, specifically expediency, to guarantee efficient actions free from unjustified omissions. This research analyzed the applicability of the principle of expediency in addressing petitions at the Human Resources Office of the Mayor's Office of Cúcuta in 2024, evaluating whether response times comply with legal deadlines and verifying possible administrative limitations that result in delayed responses or the absence of a response altogether. Methodologically, a qualitative approach was implemented, with a systematic paradigm and an analytical-descriptive design, examining the management of petitions using document analysis techniques, reviewing the applicable regulatory and jurisprudential framework, and institutional records of filing and responses, through comparative analyses of legal deadlines and response times in 2024. The results showed that, although most petitions were addressed within the legal timeframe, late responses and unanswered requests persisted, reflecting weaknesses in administrative follow-up. Overload, the difficulty of various procedures, and a lack of internal coordination influence the core nature of the process, affecting the exercise of the right to petition and leading to the filing of legal actions. In conclusion, the application of the principle in 2024 was partial and insufficient, demonstrating the need to strengthen processes, improve management, and consolidate regulatory compliance, under its guiding principles (Efficiency, Speed).
