Resumen
La mujer en Colombia ha luchado por tener un papel cada vez más importante en el mundo social y laboral, a lo largo de la historia se han evidenciado sucesos que han marcado un hito por la lucha de los derechos de las mujeres, cabe resaltar que en nuestro estado colombiano se han presentado cambios drásticos a favor del ámbito laboral, el primer avance legislativo laboral reconocía la licencia de maternidad pero no tenía presente a todas las madres (solo acobijaban a las madres biológicas) y tenían excepciones con respeto a los descansos remunerados (solo en caso de aborto o parto prematuro). Como objetivo general se tienen la de describir cuáles son los derechos que tiene la mujer trabajadora en estado de embarazo Esta investigación se justifica porque muchas personas desconocen todos los derechos que tienen las mujeres trabajadoras y es de suma importancia conocer los derechos de estas, para saber qué actitud se puede tomar ante determinados sucesos que forman parte de la vida laboral. La Metodología utilizada en el presente trabajo presenta un paradigma histórico hermenéutico enfoque histórico hermenéutico, el método inductivo y el tipo de investigación es el descriptivo. Las fuentes secundarias son las Sentencias de las altas Cortes, la técnica para utilizar es el análisis de texto. Como principal conclusión se observa la discriminación hacia la mujer trabajadora en estado de maternidad, se evidencia la vulnerabilidad de la mujer trabajadora

The general objective is to describe what are the rights that working women have in a state of pregnancy This research is justified because many people do not know all the rights that working women have and it is extremely important to know the rights of the worker to know what attitude can be taken to certain events that are part of working life. The Methodology used in the present work presents a historical hermeneutical paradigm historical hermeneutical approach, The inductive method The type of research is descriptive.
